Terms and Conditions of Sale — EKIZ

1. Purpose

These Terms and Conditions of Sale govern the sale of products offered on www.ekiz.fr by EKIZ, a sole proprietorship operating under the French micro-enterprise scheme, registered under SIRET number 99454463300013 and established at 4 rue Palestro, 13003 Marseille, France. By placing an order, the customer accepts these terms.

2. Prices

The applicable price is the price shown when the order is confirmed, in the currency displayed at checkout. Under Article 293 B of the French General Tax Code, EKIZ benefits from the VAT exemption scheme: VAT is not applicable. Any shipping charges are shown before the order is confirmed. For payments in another currency, the exchange rate and any bank charges depend on the payment provider.

3. Payment

Payment is due when the order is placed, using one of the methods offered at checkout. The order is confirmed once payment has been accepted.

4. Delivery

Available destinations and delivery methods, the applicable charges, and a delivery date or timeframe are shown before the order is confirmed. These vary according to the destination and method selected. Where delivery is carried out by a carrier offered by EKIZ, the risk of loss or damage passes to the customer when the customer, or a third party designated by them, takes physical possession of the product. If the customer appoints a carrier other than those offered by EKIZ, the risk passes when the product is handed over to that carrier, in accordance with applicable law.

5. Right of withdrawal

A consumer entitled to the right of withdrawal has 14 calendar days from receipt of the product to notify EKIZ of their decision to withdraw, without giving a reason. Notice may be sent to contact@ekiz.fr using the model form below or any other unambiguous statement. Simply returning the product does not constitute notice of withdrawal. The product must be sent back no later than 14 days after the notice. EKIZ will provide the return instructions and return location appropriate to the order. Direct return costs are borne by the customer, except where EKIZ made an error, the product is defective, or mandatory law provides otherwise.

The customer may examine and try on the product as they would in a shop. They may be liable for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the product. Lack of original packaging does not, by itself, extinguish the statutory right of withdrawal.

6. Refunds and exchanges

Following a valid withdrawal, EKIZ refunds the amounts paid, including the initial shipping charge corresponding to the least expensive standard delivery method offered, using the original payment method, no later than 14 days after being informed of the withdrawal. EKIZ may withhold the refund until it has received the product or the customer has provided proof of return shipment, whichever occurs first. Exchanges depend on stock availability and do not affect the customer’s statutory rights.

7. Statutory warranties

The customer benefits from applicable statutory warranties, including the French statutory guarantee of conformity under Articles L.217-3 et seq. of the Consumer Code and the warranty against hidden defects under Articles 1641 et seq. of the Civil Code. These rights are separate from the right of withdrawal. For any claim, contact contact@ekiz.fr.

8. Liability

Nothing in these terms limits or excludes mandatory consumer rights or warranties, or EKIZ’s liability where the law does not permit such a limitation.

9. Intellectual property

Texts, logos, photographs, images, videos, trademarks and design elements on the website belong to EKIZ or their respective owners and are protected by intellectual property rights. Reproduction or commercial use without prior permission is prohibited.

10. Force majeure

EKIZ shall not be liable for a failure to perform caused by a force majeure event within the meaning of Article 1218 of the French Civil Code.

11. Governing law and disputes

These terms are governed by French law, without depriving consumers of mandatory protections applicable in their country of residence. In the event of a complaint, the customer may first contact EKIZ at contact@ekiz.fr. If no amicable solution is reached, the customer may bring the matter before the competent courts under the applicable rules. Details of EKIZ’s consumer mediator will be added once appointed.

12. Customer service

For any question or complaint: contact@ekiz.fr.

13. Orders outside the European Union

Orders from countries outside the European Union are subject to these terms to the extent permitted by applicable law. Any customs duties or import charges are shown at checkout when collected by EKIZ; otherwise, they may be charged by the authorities in the destination country. EKIZ may decline an order where legal or logistical constraints prevent delivery.
